"FACTBOX-Yellen describes planned tax hikes, OECD negotiations, carbon pricing"

WASHINGTON, Jan 21 (Reuters) - U.S. Treasury nominee Janet Yellen underscored in writing on Thursday the Biden administration’s intent to remake tax and trade policy after conquering the coronavirus pandemic and making domestic investments in workers and infrastructure.

The Senate Finance Committee plans to consider her nomination for Treasury Secretary for 10 a.m. EST on Friday.

Following are some of Yellen’s written responses to additional questions from committee members, according to a copy of the responses obtained by Reuters:

STATE LOCAL TAX DEDUCTION:

* Yellen said it was critical to evaluate the effect of a 2017 cap on deductions of state and has on state and local governments and their residents.

“I will work with those at Treasury and throughout the administration in evaluating those impacts, as well as other aspects of this issue.”

CORPORATE TAXES:

* Yellen said she agrees with Biden’s proposed increase of the U.S. corporate tax rate to 28%.

* Yellen said Biden’s proposal for a 15% minimum tax on booked income, rather than taxable income, would recapture tax revenue lost to tax avoidance by companies with low or zero tax liabilities.

* On international and digital tax disputes Yellen said: “We are committed to the cooperative multilateral effort to address base erosion and profit shifting through the OECD/G20 process, and to working to resolve the digital taxation disputes in that context.”

* Yellen said a global minimum tax agreed within the OECD would stop a “destructive global race to the bottom on corporate taxation”

* Yellen sidestepped questions on whether to raise the 20% tax rate for “pass-through” small businesses including sole proprietorships, saying the 2017 provision needed to be studied “to determine the extent to which it is helping to improve the prospects of America’s small business owners.”

WEALTH, CAPITAL GAINS TAXES:

* Yellen said Biden has not proposed a specific wealth tax but would “tax the investment income of families making more than $1 million at the same rate they pay on their wages and to tax some previously untaxed capital gains on the final return of wealthy taxpayers."

* Yellen said she would work with IRS and the Congress to focus enforcement activity on the largest sources of the gap between taxes owed and taxes aid.

TREASURY SECURITIES PORTFOLIO:

* Yellen said she would analyze the mix of debt securities now issued by the U.S. government, including the weighted-average maturity of the U.S. debt, which was 65 months as of December, five months shorter than at the end of 2019 because of the volume of short-term T-bills issued to finance COVID-19 relief measures.

* Yellen did not directly respond to a question about how she would coordinate with the Federal Reserve in the event the central bank adopts yield curve control measures.

* Yellen signaled no rush to pursue a 100-year maturity Treasury bond.

“Today, the demand for existing Treasury instruments remains robust and is sufficient to meet U.S. financing needs."

"Introducing new, ultra-long-term instruments would add new complexities to this market and deserves further study in light of the many factors that determine U.S. Treasury market policy.”

FEDERAL RESERVE:

* Yellen said she believes strongly in upholding the norms of an independent Federal Reserve.

“Given my prior leadership at the Federal Reserve, I understand deeply why it is so important to maintain the tradition of the independence of the Fed in monetary policy."

"In areas where it will be appropriate and necessary for coordination between the Treasury and the Fed, I, if confirmed, will certainly take those responsibilities seriously and will be well-positioned to work seamlessly with Chairman Powell.”

* Yellen said the Fed’s Main Street Lending program and other expired coronavirus Fed 13(3) lending facilities will not be available.

She did not commit to reviving them, saying she would work to ensuring that “additional support particularly gets to small, mid-size businesses that have been hardest hit during the crisis.”

UNEMPLOYMENT BENEFITS:

* Yellen said the COVID-19 pandemic has highlighted the need for U.S. unemployment insurance system to be updated and expanded and a system of automatic stabilizers “is an important step to take now so that we can minimize the negative impacts of any future recessions.”

INTERNATIONAL MONETARY FUND:

* Yellen left the door open to an allocation of IMF Special Drawing Rights for all member countries.

Said she would analyze ways to strengthen support for the most vulnerable countries.

“I look forward to studying the issue further and pledge to adhere to the legal requirement to consult with Congress before making a decision on the U.S. position on an SDR allocation.”

CARBON PRICING:

* Yellen said “we cannot solve the climate crisis without effective carbon pricing.”

* She reiterated her support for using financial regulation to combat risks from climate change, in response to a question asking her to commit not to do so.

* Yellen said she will advise Biden on achieving net-zero emissions no later than 2050 “based on the principle that polluters must bear the full cost of the carbon pollution they are emitting.”

THE DOLLAR AND CURRENCY MANIPULATION:

* Yellen reiterated her commitment to allow the dollar’s value to be determined by market forces.

“The world can be certain that the United States will not seek a weaker currency to gain competitive advantage.”

* She also committed to pressuring countries suspected of devaluing their currencies.

“The Biden-Harris Administration will be examining how Treasury, Commerce and (the U.S. Trade Representative) can work together to put effective pressure on countries that are intervening in the foreign exchange market to gain a trade advantage.”

CRYPTOCURRENCIES:

* Yellen said she plans to work with other authorities for an approach to regulating bitcoin and other cryptocurrenices.

“I think we need to look closely at how to encourage their use for legitimate activities while curtailing their use for malign and illegal activities."

"If confirmed, I intend to work closely with the Federal Reserve Board and the other federal banking and securities regulators on how to implement an effective regulatory framework for these and other fintech innovations.”

Of course, as these things go, there is another set of scholars who argue the insurrection against Nancy Pelosi was really more similar in character to the second Catilinarian conspiracy, that infamous and dastardly plot devised by the Roman senator Lucius Sergius Catilina (or Catiline), with the help of a group of fellow aristocrats and disaffected veterans of Lucius Cornelius Sulla, to overthrow the consulship of Marcus Tullius Cicero and Gaius Antonius Hybrida.

In any event, people, the forces of Nancy Pelosi were able to beat off the forces of the Republicans trying to stage a coup here, so Nancy and AOC are both safe, thank the good Lord for that because in this, our nation’s hour of crisis, we need them both now more than ever to unite and heal America.

As to AOC, and my goodness, what that poor woman has had to go through, what with looking at pictures of men, always men, who want to kill her every morning with her coffee, and now this, being almost very nearly assassinated by Trump, we have this from the tear-jerking story of the life of AOC, defender of freedom in ELLE entitled “Alexandria Ocasio-Cortez Says She Feared She’d Die During Capitol Riot After ‘Very Close Encounter’ – ‘I did not know if I was going to make it to the end of that day alive'” by Alyssa Bailey on Jan 13, 2021, to wit:

Ocasio-Cortez also addressed her current health status in the video, saying she still remains traumatized by what happened.

“My body and my brain have been out of work,” she said.

For the two days after the riots, “I just slept a lot more than I usually sleep, and that to me is telling me that my body is going through something and my brain is trying to heal.”

Pray for her, people, she needs it, and let us hope that if we all do pray fervently enough, her brain could one day finally heal and she would be able to feel good about herself as a person again, after that harrowing experience of almost very nearly getting assassinated!

As to Joe Biden, he is holed up in Washington, D.C., safely surrounded by some 25,000 military troops who are all loyal to Joe Biden, and tanks and razor wire to keep him safe from the American people, like he was a third-world dictator in a banana republic in South America or Africa, where by imperial decree, he has altered our Constitution to make us into a Socialist Democracy and he has given us a new history to replace our old history in order to unite everyone in America and to heal the nation.

And while we are on the subject of these Democrats making it up as they go and making some very serious criminal charges in the process against Republicans without presenting any evidence to back them up, which is precisely what the Democrats and their enablers in the media were always accusing Trump of doing, let’s go back to the CNN (Cuomo News Network) article entitled “Questions swirl around possible ‘insider’ help for Capitol attack” by Marshall Cohen on January 14, 2021, where we have more hysteria mongering and serious allegations of criminal conduct by Republicans and the Capitol Police from the Democrats, to wit:

More than 70 people have already been charged with federal crimes related to the attack.

Most of the publicly disclosed cases involve people who fought with police officers inside the Capitol, made violent threats against Democrats, or were found near the complex with guns or bombs.

Making threats against Democrats in America is not only a seditious (inciting or causing people to rebel against the authority of a state or monarch) act, but a serious federal felony punishable by fines and up to 20 years in prison and it refers to the act of inciting revolt or violence against a lawful authority, in this case Nancy Pelosi, with the goal of destroying or overthrowing it.

Prosecutors haven’t yet accused any of those Trump supporters of coordinating with Republican lawmakers or sympathetic police officers, but the massive investigation is still in its early stages.

“We’re looking at significant felony cases tied to sedition and conspiracy,” Michael Sherwin, the acting US attorney for Washington, DC, told reporters on Tuesday, without specifically saying whether any lawmakers or members of law enforcement were under investigation.

But Sherwin added, “Our office organized a strike force of very senior national security prosecutors and public corruption prosecutors.”

“Their only marching orders from me are to build seditious and conspiracy charges related to the most heinous acts that occurred in the Capitol.”

And here we get to the meat of the matter, why it will be necessary for the Democrats to organize their own armed party military wing whose members are sworn to the Democrat party to protect the Democrats from the American people, to wit:

Insider help from police and military

At least two US Capitol Police officers have already been suspended, and at least 10 more are under investigation, for allegedly playing some sort of role in the insurrection, CNN reported.

There was immediate speculation after the attack that some sympathetic police officers may have helped the rioters, given the fact that the raucous and at-times violent crowd seemed to mill about the Capitol complex with little resistance.

One rioter even posed for a selfie with a cop.

And let’s stop there for a moment to examine that statement in some detail using logic and reason: if the dude was standing next to a cop while posing for a selfie, then it logically follows that he was not at the same time “rioting,” where rioting in our language, anyway, means the violent disturbance of the peace by a crowd.

If a dude is standing next to a cop taking a selfie, then can he at the same time be engaged in a violent disturbance of the peace?

So how CNN makes him out to be a rioter eludes rationality for the moment, but there is no requirement for CNN to be rational, and so they are not, which brings us back to the story for more as follows:

Democrats ask for investigation on tours

On Wednesday, 31 members of Congress sent a letter to the acting House Sergeant of Arms, acting Senate Sergeant of Arms and Acting Chief of the US Capitol Police asking them to investigate the issue of tours further.

Democratic Rep. Mary Gay Scanlon, one of the co-signers of the letter, confirmed to CNN that she saw groups of tours of people in MAGA apparel one or two days before the attack.

“I had seen what appeared to be tour groups of folks dressed in MAGA attire, in the halls, in the tunnels,” Scanlon told CNN.

“I don’t know exactly what day it was.”

She doesn’t know exactly what day it was, which means it could have been last year for all we know, and of course if the Republicans were going to stage a coup against the iron-fisted rule of Nancy Pelosi in the House of Representatives, the most hated woman in America today now that Hillary Clinton isn’t in the spotlight to take that honor, anymore, they would make sure that when they were drilling their paramilitary forces beforehand as to where to go in the Capitol to assassinate Nancy Pelosi and all the Democrats including AOC, who almost very nearly was actually assassinated, and Elaine Luria, as well, they would make sure to have them dressed up in their MAGA uniforms so everybody would know who they were.

“So I kind of assumed it must be a new member who didn’t know the rules or something.”

“But, I mean, I can verify that it happened.”

“There were people who were roaming around in the halls, apparently under the guidance of congressional staff.”

Scanlon told CNN she saw a group of 6 to 8 people.

“Many of the Members who signed this letter, including those of us who have served in the military and are trained to recognize suspicious activity, as well as various members of our staff, witnessed an extremely high number of outside groups in the complex on Tuesday, January 5,” the letter states.

It says the tours were “unusual” and “concerning” and were reported to the Sergeant at Arms on January 5.

The letter says the groups “could only have gained access to the Capitol Complex from a Member of Congress or a member of their staff.”

Look at the stack of evidence against them!

It’s overwhelming!

So what is the solution?

Easy, outlaw the Republican party for treason, sedition, conspiracy and for being just plain mean and ornery, jail all the Republicans who aren’t to be executed, and make America into a one-party rule so that this kind of crap can never happen again.

"CDC quietly changes Covid vaccine guidance to OK mixing Pfizer and Moderna shots in ‘exceptional situations’"

The Centers for Disease Control and Prevention quietly changed its guidance on Covid-19 vaccine shots, saying it’s now OK to mix Pfizer’s and Moderna’s shots in “exceptional situations” and that it’s also fine to wait up to six weeks to get the second shot of either company’s two-dose immunization.

While Pfizer’s and Moderna’s vaccines, which both use messenger RNA technology, were authorized to be given 21 and 28 days apart, respectively, the agency now says you can receive either shot so long as they are given at least 28 days apart, according to new guidance posted Thursday on its website.

Although “every effort” should be made to ensure a patient receives the same vaccine, in rare situations “any available mRNA COVID-19 vaccine may be administered at a minimum interval of 28 days between doses” — if supplies are limited or the patient doesn’t know which vaccine they originally received, the CDC’s new guidance says.

The agency says the two products are not interchangeable, and acknowledged that it hadn’t yet studied whether its new recommendations would change the safety or effectiveness of either vaccine.

But vaccine research specialists who spoke with CNBC said that the two immunizations are so similar in design that people shouldn’t be worried about the rare instances in which the doses will be mixed.

“The intent is not to suggest people do anything different, but provide clinicians with flexibility for exceptional circumstances,” Jason McDonald, a spokesman for CDC, said Friday in an email to CNBC.

The CDC said health-care providers should give patients a vaccination record card that tells them when they received their first shot and which kind of shot it was to help ensure that patients know which shot they ought to receive the second time.

The agency also recommends that providers enter the patient’s vaccination information into their medical records and the government’s immunization information system.

Ramon Lorenzo Redondo, a molecular virologist at Northwestern University’s Feinberg School of Medicine who reviewed the CDC’s updated guidance, said health-care providers should try to stick to the recommended schedule.

But, he added, there will be some “emergency situations” like the ones described by the CDC that might require switching of the shots.

While there’s no data on this and it’s certainly not the optimal route, he said, it’s unlikely to be damaging so it’s a reasonable protocol.

The CDC’s new guidance comes after public health authorities in the United Kingdom similarly updated their Covid-19 vaccine guidance earlier this month.

If the manufacturer of the first shot isn’t known or if a second dose of the shot a patient first received isn’t available, “it is reasonable” to substitute another shot, U.K. health officials say in their updated playbook.

It’s not the preferred course of action, but it is allowed.

John Moore, a vaccine researcher at Cornell University who has reviewed the new CDC guidance, said in a phone interview Friday with CNBC that the change “makes sense.”

He said the Pfizer and Moderna vaccines are very similar and while it hasn’t been studied, there’s no immediately apparent reason to think that mixing doses would lower efficacy or reduce safety.

“The FDA and CDC are allowing mix and match."

"They’re not recommending it."

"I don’t think it’s something that will happen regularly, but I can’t imagine that there would be any harm to anyone by doing this and that of course is the first priority,” he said.

“These are unusual times."

"So in unusual times, you have to consider unusual changes to protocol.”

Moore, who specializes in HIV vaccine research, said it’s common to use experimental vaccines sequentially to research the effect on HIV.

He said it’s uncommon to do this outside of a research setting, but the country is currently in extraordinary circumstances.

“There’s no good reason to think that there would be a safety concern that is created in this situation and you would strongly expect the efficacy to be substantially unchanged,” he said.

Both companies require two doses to achieve maximum protection from the coronavirus.

While both shots should be administered according to the originally recommended guidelines, the CDC said the second dose of either companies’ vaccine could be delayed as long as six weeks if necessary.

The updated guidance comes as some cities and counties across the country are canceling vaccine appointments because they don’t have as many doses as they originally expected.

Wayne County, Michigan, for example, said last week it would prioritize making sure that people who got their first shot get their second shot on time.

But the county said it had to cancel almost 1,400 appointments for people to get their first shot.

The Pfizer and Moderna vaccines are “extraordinarily similar,” Dr. Bill Schaffner, an epidemiologist at Vanderbilt University, said in a phone interview, so there’s no reason to think that there would be any adverse reaction to mixing the vaccines.

It was important for the CDC to put out this guidance, Schaffner said, because the vaccine registry systems across the country, which are run by states, vary in quality.

So some information may be lost, leaving people unaware of which vaccine they received.

He added that some people might travel across state lines and receive their second dose in a different state, further complicating the matter.

“Although this mixing and matching, as we call it, has not been specifically studied, there’s no biological reason for this not to work and be justified,” he said.

Dr. Nancy Messonnier, director of the CDC’s National Center for Immunization and Respiratory Diseases, was asked Friday about the interval at which the two shots should be administered.

“The data that we have is on a two-dose vaccine at the recommended schedule, 21 or 28 days,” she said at a virtual event hosted by the Harvard T.H. Chan School of Public Health and National Public Radio.

“At this point we at CDC agree with what FDA has said and FDA has been very clear that we should be using the approved regimen.”

“It’s rooted solidly in the science and the available evidence, and to do something different than that would be not following the science and potentially not allowing us to really realize the full potential of these vaccines,” she said.

“So for now, from the CDC perspective, we think that it has to be two doses on the recommended schedule.”

Article of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Donald John Trump, President of the United States of America, in maintenance and support of its impeachment against him for high crimes and misdemeanors.

ARTICLE 1: INCITEMENT OF INSURRECTION

The Constitution provides that the House of Representatives "shall have the sole Power of Impeachment" and that the President "shall be removed from Office on Impeachment, for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors."

Further, section 3 of the 14th Amendment to the Constitution prohibits any person who has "engaged in insurrection or rebellion against" the United States from "hold[ing] and office ... under the United States.'

In his conduct while President of the United States — and in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, provide, protect, and defend the Constitution of the United States and in violation of his constitutional duty to take care that the laws be faithfully executed — Donald John Trump engaged in high Crimes and Misdemeanors by inciting violence against the Government of the United States, in that:

On January 6, 2021, pursuant to the 12th Amendment to the Constitution of the United States, the Vice President of the United States, the House of Representatives, and the Senate met at the United States Capitol for a Joint Session of Congress to count the votes of the Electoral College.

In the months preceding the Joint Session, President Trump repeatedly issued false statements asserting that the Presidential election results were the product of widespread fraud and should not be accepted by the American people or certified by State or Federal officials.

Shortly before the Joint Session commenced, President Trump, addressed a crowd at the Ellipse in Washington, D.C.

There, he reiterated false claims that "we won this election, and we won it by a landslide."

He also willfully made statements that, in context, encouraged — and foreseeably resulted in — lawless action at the Capitol, such as: "if you don't fight like hell you're not going to have a country anymore."

Thus incited by President Trump, members of the crowd he had addressed, in an attempt to, among other objectives, interfere with the Joint Session's solemn constitutional duty to certify the results of the 2020 Presidential election, unlawfully breached and vandalized the Capitol, injured and killed law enforcement personnel, menaced Members of Congress, the Vice President, and Congressional personnel, and engaged in other violent, deadly, destructive and seditious acts.

President Trump's conduct on January 6, 2021, followed his prior efforts to subvert and obstruct the certification of the results of the 2020 Presidential election.

Those prior efforts included a phone call on January 2, 2021, during which President Trump urged the secretary of state of Georgia, Brad Raffensperger, to "find" enough votes to overturn the Georgia Presidential election results and threatened Secretary Raffensperger if he failed to do so.

In all this, President Trump gravely endangered the security of the United States and its institutions of Government.

He threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of Government.

He thereby betrayed his trust as President, to the manifest injury of the people of the United States.

Wherefore, Donald John Trump, by such conduct, has demonstrated that he will remain a threat to national security, democracy, and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law.

Donald John Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.

And as we consider the fact that right after Joe Biden came into office, he took the dictatorial action of not only essentially changing the purpose of our national government unilaterally, substituting a form of “National Socialism” in place of our Republican frame of government, but further he took the incredible action of decreeing to us what our political history is now going to be, which is a perverted version of our actual history meant to serve as a “historical” basis for Joe changing our constitution to have it favor the “oppressed” in America, the “people of color” and the LGBQT’s, for example, in this case, to the detriment of their “oppressors,” people in America with white skin who are heteronormative and have stable, law-abiding nuclear families, we need to pay heed to this definition of fascism above here, to see if it didn’t just get here with the ascension of Joe Biden into the office of chief magistrate of the United States of America.

As to national socialism, it is a form of government that seeks to convince all parts of society to subordinate their personal interests to the “common good,” and as Joe Biden tries to “unite” us, at the point of a bayonet, if necessary, to “heal” the nation, that is exactly what Joe Biden is to trying to convince us to do – subordinate our personal interests to a “common good” that is going to be determined unilaterally by Joe Biden and imposed on us by fiat, by decree, which is what happened on 20 January 2021 when Joe Biden signed an executive order decreeing that advancing equity for all is the government’s responsibility.

Think very carefully on what those words actually mean, people, because words have meaning, and those meanings have consequences.

As we ponder the ramifications to our nation of that decree by Joe Biden on 20 January 2021 that advancing equity for all is now the responsibility of the national government of the United States of America under Joe Biden, consider that while equality, which is what we are supposed to have in this country, everybody equal, is typically defined as treating everyone the same and giving everyone access to the same opportunities, equity refers to proportional representation by race, class, gender, etc. in those same opportunities.

Of importance to this discussion, consider that while the terms equality and equity are often used interchangeably, they differ in important ways, and to achieve equity, policies and procedures may result in an unequal distribution of resources, which is to say, today in America under Joe Biden, we are all equal, but some are more equal than others.

In America today, we do not have a common body of citizens, each equal to the other; in America today, based on Joe Biden’s executive order decreeing that advancing equity for all is the government’s responsibility, we now have classes of citizens, each with different sets of “rights” when it comes to distribution of government “services,” which under Joe’s decree, are now to be directed at “underserved” communities, an undefined and nebulous term to be determined on a case-by-case basis.

So what Joe is clearly saying by this decree that advancing equity for all is now the government’s responsibility is that today, America now has a system of government in which each class has its distinct place, function, and representation in the government, which is a characteristic of a fascist government, not a Republican government such as is guaranteed to each and every one of us by the Constitution Joe Biden unilaterally scrapped on 20 January 2021 when his dictatorship began.

As to the form of Republican government we are supposed to have, but no longer do, let’s go to the Center for Civic Education site as follows, keeping in mind that this is the history of America that Joe Biden scrapped by fiat on 20 January 2021 with an executive order decreeing a different history of America to be taught, to wit:

"No, You Can’t Try an Impeached Former President"

Now that Donald Trump is a private citizen, the Senate should dismiss the article of impeachment against him for lack of jurisdiction.

The Constitution is clear: “The president . . . shall be removed from office on impeachment . . . and conviction” — not by the expiration of his term before the impeachment process is complete.

It also mandates that “judgment in cases of impeachment shall not extend further than to removal and disqualification“ — not or disqualification.

When the Constitution was written, several states allowed impeachment of former officials.

The Framers could easily have included that provision, but they didn’t.

They also explicitly chose to prohibit the British practice of trial by legislature— excepting only impeachment — and “bill of attainder,” any punitive legislative act against a specific person.

The courts have held that the punishments prohibited by the Bill of Attainder Clause include disqualification from holding office.

Moreover, the Constitution requires the chief justice to preside “when the president of the United States is tried.”

No former official has ever been convicted by the Senate, and only one has been impeached.

Secretary of War William W. Belknap was indisputably guilty of numerous impeachable offences, to which he confessed as he resigned his office hours before the House unanimously impeached him in 1876.

The Senate voted in favor of a procedural motion affirming its jurisdiction to try Belknap’s impeachment.

But two dozen senators who believed he was guilty voted to acquit on jurisdictional grounds.

A close vote nearly a century and a half ago doesn’t establish a binding precedent.

A more compelling precedent is the House’s decision not to impeach Richard Nixon.

After he left office in 1974 to avoid certain impeachment and conviction, there was no movement to continue the process.

Beyond the constitution, there are strong policy and historical reasons an incoming administration shouldn’t seek recriminations against its predecessor.

In some countries defeated former presidents and prime ministers are routinely prosecuted.

America has lived more in accordance with President Lincoln’s message to the soon-to-be-defeated Confederacy: “With Malice toward none, with charity for all, with firmness in the right, as God gives us to see the right, let us strive on to finish the work we are in, to bind up the nation’s wounds.”

Joe Biden doesn’t need Congress and Joe Biden isn’t waiting for Congress because according to our esteemed Constitutional scholar G Anderson, Article Two of the United States Constitution gives the president broad executive and enforcement authority to use his or her discretion to determine how to enforce the law or to otherwise manage the resources and staff of the executive branch, along with the authority, jurisdiction and discretion to simply bypass Congress and by executive order, make laws for all of us by himself with no Congressional oversight whatsoever.

To which I respond, whether or not the Constitution gives Joe Biden the power to declare himself a dictator in the United States of America, the fact is, he has done so, and my point is that once that dictatorship has been established, it is here for good because the one thing universally true about tyrants, despots and dictators is that once they have taken power like Joe Biden has done here, protected as he is from the American people in his imperial city by 25,000 armed troops of proven loyalty to him personally, and battle tanks and razor wire, they never give it up, but keep on grasping for more and more until like Hitler they have throttled the life out of a nation.

And in response to the premise of G Anderson that Article II of OUR Constitution allows Joe Biden to declare himself a dictator who doesn’t need Congress for him to make laws and direct the expenditure of monies without Congressional oversight, I simply go back to the 1935 State of the Union address of FDR, and make the observation that if the premise of G Anderson that Article II of OUR Constitution allows Joe Biden to bypass Congress and make laws on his own, FDR certainly would have known about as well, and his 1935 State of the Union would never then have read thusly, to wit:

Let us for a moment strip from our simple purpose the confusion that results from a multiplicity of detail and from millions of written and spoken words.

We find our population suffering from old inequalities, little changed by past sporadic remedies.

In spite of our efforts and in spite of our talk we have not weeded out the overpriviledged (HILLARY Clinton) and we have not effectively lifted up the underpriviledged (disabled veterans such as myself).

Both of these manifestations of injustice have retarded happiness.

No wise man has any intention of destroying what is known as the “profit motive”, because by the profit motive we mean the right by work to earn a decent livelihood for ourselves and our families.

We have, however, a clear mandate from the people, that Americans must forswear that conception of the acquisition of wealth which, through excessive profits, creates undue private power over private affairs and, to our misfortune, over public affairs as well.

In building toward this end we do not destroy ambition, nor do we seek to divide our wealth into equal shares on stated occasions.

(Dividing our wealth into equal shares is what the equity of Joe Biden is all about)

We continue to recognize the greater ability of some to earn more than others.

I recall to your attention my message to the Congress last June in which I said, “Among our objectives I place the security of the men, women, and children of the Nation first.”

That remains our first and continuing task: and in a very real sense every major legislative enactment of this Congress should be a component part of it.

And that takes us back to 1935 and FDR, as follows:

Now, it can safely be said that FDR was faced with as much of a “crisis” then as Joe Biden thinks he is today, but did FDR declare himself a dictator like Joe Biden who can forsake Congress when he feels like making some laws of his own?

Not hardly is that answer, as we can see by going back to 1935, as follows:

I am now ready to submit to the Congress a broad program designed ultimately to establish all three of these factors of security – a program which because of many lost years will take many future years to fulfill.

In his turn, Joe Biden is simply side-stepping Congress to enact his own agenda.

Going back to 1935:

The lessons of history, confirmed by the evidence immediately before me, show conclusively that continued dependence upon relief induces a spiritual disintegration fundamentally destructive to the national fiber.

To dole our relief in this way is to administer a narcotic, a subtle destroyer of the human spirit.

It is inimical to the dictates of a sound policy.

It is in violation of the traditions of America.

Work must be found for able-bodied but destitute workers.

The Federal Government must and shall quit this business of relief.

I am not willing that the vitality of our people be further sapped by the giving of cash, of market baskets, of a few hours of weekly work cutting grass, raking leaves, or picking up papers in the public parks.

We must preserve not only the bodies of the unemployed from destitution but also their self-respect, their self-reliance, and courage and determination.

This decision brings me to the problem of what the Government should do with approximately 5,000,000 unemployed now on the relief rolls.

About one million and a half of these belong to the group which in the past was dependent upon local welfare efforts.

Most of them are unable for one reason or another to maintain themselves independently – for the most part, through no fault of their own.

Such people, in the days before the great depression, were cared for by local effort – by States, by counties, by towns, by cities, by churches, and by private welfare agencies.

It is my thought that in the future they must be cared for as they were before.

Did Joe Biden follow that procedure?

Before he became president as a result of a coup, did Joe Biden go see Bill Barr with his executive order on equity?

Or did Joe, having proclaimed himself a dictator following his 8 January 2021 proclamation and declaration of an insurrection in the Ten Miles Square, simply blow off those requirements as being not applicable to him?

Which takes us to James Madison, himself a former American president, and his warning to us in Federalist No. 48 that “(A)n elective despotism was not the government we fought for; but one in which the powers of government should be so divided and balanced among the several bodies of magistracy as that no one could transcend their legal limits without being effectually checked and restrained by others.”

But regardless, an elective despotism (the exercise of absolute power, especially in a cruel and oppressive way; a country or political system where the ruler holds absolute power) is now what we have, and as our Constitutional scholar G Anderson makes incandescently clear above here, there really is ****-all we American citizens can do about it, since the reality of the situation is that despite anything to the contrary, American presidents, especially when we have ONE-PARTY RULE like we do in the United States of America today, a tyranny of the minority, are above the law and answerable to no one, period, despite what Chief Justice Jackson wrote in the 1952 case of Youngstown Sheet & Tube Company v. Sawyer, to wit:

“In the framework of our Constitution, the President’s power to see the laws are faithfully executed refutes the idea that he is to be a lawmaker.…”

“The Constitution is neither silent nor equivocal about who shall make laws which the President is to execute.”

But because Joe Biden is now a dictator, he in fact has become a lawmaker, as he has just proved on 20 January 2021 with his executive order on equity.

Upon such reading of any such certificate or paper (from electoral college), the President of the Senate (Pence) shall call for objections, if any.

Every objection shall be made in writing, and shall state clearly and concisely, and without argument, the ground thereof, and shall be signed by at least one Senator and one Member of the House of Representatives before the same shall be received.

When the two Houses have voted, they shall immediately again meet, and the presiding officer shall then announce the decision of the questions submitted.

No votes or papers from any other State shall be acted upon until the objections previously made to the votes or papers from any State shall have been finally disposed of.

What we know is that the Democrats DID NOT want that to happen, and to stop it from happening, the Democrats first threatened those Republicans with harm, and when they persisted in exercising their legal rights on behalf of their constituents, the Democrats called forth their mob to terrorize and intimidate those Republicans and sow such fear and terror into their hearts that out of fear for their lives, they would submit to Democrat demands and declare Joe Biden the new president of the United States of America, which is exactly what happened, where we had a very fearful and frightened Sen. Kelly Loeffler saying out of fear for her very life that while she had “fully intended to object to the certification of the electoral votes . . . , the events that have transpired today have forced me to reconsider, and I cannot now, in good conscience, object to the certification of these electors.”

And that is how a DEMOCRAT MOB made Joe Biden president of the United States of America on 6 January 2021, a day that will go down in history as a day of infamy in America.
