THE BALLAD OF THE SHOW TRIAL OF PATRICK WING OF POESTENKILL!
And in the end, of course, it really wasn't much of a trial, as trials go, but then, they never really are, these so-called and aptly-named "Stalin-esque Show Trials," where the evidence is read into the record by the "State's" prosecutor, in this case Poestenkill councilman Frank Burzesi, NYSPE # #070866, the sentence of "guilty as charged" is then read into the record by the "State's" prosecutor, and the accused is then taken out and shot for the "good of the State," in this case the "State" being the Free and Independent Republic of Poestenkill, and such metaphorically was the fate of Poestenkill resident and exemplary town citizen Patrick Wing at the October 10, 2024 meeting of the Poestenkill Town Board https://www.youtube.com/watch?v=6MvxQjuiepY at 42:26, where he was very publicly jacked up by councilman Burzesi on charges of being uncivil along with the intentional dissemination of misinformation and disinformation about the Poestenkill Town Board while failing to get proper permission from Poestenkill to speak before actually speaking, and failure to seek permission for his content from Poestenkill's "Culture" unit, headed up by Poestenkill supervisor and Minister of Civility Tom Russell, who is implementing DEI in Poestenkill while making sure the lower classes in Poestenkill are civil to their betters in Poestenkill so as to not hurt their feelings, which unit under Russell determines whether the ‘tone, content, and intention’ of anything of a political nature to be published by a town resident is suitable for publication in Poestenkill, as well as failing to seek prior permission to publish from Poestenkill's "Standards and Practices" division headed up by councilman Burzesi, with Poestenkill's "Culture" Unit having a four-pronged role in Poestenkill as a reviewer, an incubator, a producer and a library, with the unit seeing its primary role as a reviewer to ensure all citizen publications in Poestenkill have the proper context, tone and intention.
Except those charges brought against Patrick Wing by councilman Burzesi during the October 10, 2024 Poestenkill Town Board meeting were ridiculous horsecrap, and constitute a clear cut violation of Mr. Wing's First Amendment right to engage in political speech in Poestenkill without fear of retaliation or retribution by Poestenkill and Frank Burzesi chilling his right to engage in political speech in Poestenkill, even if Frank Burzesi doesn't like it.
Patrick Wing did not put out either misinformation or disinformation.
Patrick Wing did not put out a political hit-piece.
Patrick Wing deceived no one by placing the logo of the Town of Poestenkill on the Fall 2024 edition of the "Poestenkill Spotlight."
And Patrick Wing's use of the Poestenkill logo on the cover of the Fall 2024 edition of the "Poestenkill Spotlight" falls under the category of political speech protected by the First Amendment (see, Rothamel v. Fluvanna Cnty., 810 F. Supp. 2d 771) and the Town of Poestenkill cannot restrict the use of that logo, which cannot by federal law be patented or trademarked (see, Renna v. Cnty. of Union, 88 F. Supp. 3d 310).
Nor is this jeremiad against Patrick Wing by Burzesi on October 10, 2024 inviting another federal civil rights lawsuit against Poestenkill the first time Frank Burzesi has attacked Patrick Wing for engaging in Constitutionally-protected speech in Poestenkill, this being the same Frank Burzesi who previously attacked Patrick Wing with an unhinged and deranged Manifesto and Denunciato calling down anathema on the heads of Pat and Jen Wing of Poestenkill issued townwide by candidate Burzesi in writing just before the election on 7 November 2023, in a futile effort by candidate and Poestenkill Zoning Board Chairman Burzesi to get his crony and puppet master Keith Hammond re-elected as town supervisor by denouncing Pat and Jen Wing therein as follows, to wit:
"Keith is working hard despite the headwinds from people like Pat and Jen Wing."
Then in his November 2023 Manifesto against Pat and Jen Wing, Frank Burzesi made these following unhinged and absurd statements that call into question his very sanity and grasp of reality, and thus, fitness to serve, to wit:
"The $225,000 settlement (against Poestenkill thanks to Keith Hammond) was paid to the firewood processor that Pat and Jen were complaining about."
"The Wings complaint and actions led to the violation of his rights and the settlement."

That's absurd and what a stupid statement that was that any actions of the Wing's, specifically coming to the town and asking that the Code be enforced, led to violation of anybody's rights in Poestenkill, and if Burzesi was acting in a sane, rational and responsible manner, as opposed to spouting pure political nonsense, he would have gone online to review the lawsuit and all the papers associated with it at https://dockets.justia.com/docket/new-y ... 758/129401 , where he would have found as follows:

As can clearly be seen from the Docket, the Wings were never defendants in that matter, as they would have been had they, as Burzesi falsely claims, been the cause of a violation of Hitchcock's rights, so why did Burzesi choose to lie to us about that?
From there, Burzesi next states as follows:
"Pat's comments on the ZBA and its workings display a lack of understanding of the board."
Really, people, that is a totally ridiculous claim because the "workings," as Burzesi calls them, of the ZBA are the subject of Poestenkill Town Code Article XIII, and as one reads through that Article, it is patently clear that it is Burzesi himself who is grossly ignorant as to how the ZBA is supposed to lawfully operate, because he goes by his whims and prejudices and feelings, not the law and regulations as written.
And then we come to this:
"Pat's statements attributed to Keith Hammond are a combination of misrepresentation and fiction."
Actually, that should read that Frank Burzesi's statements attributed to Pat Wing are a combination of misrepresentation, fiction, and pure poppycock.
So, people of Poestenkill, in conclusion, please do the right thing for yourself, your family, and your community.
Demand Frank Burzesi resign as a Poestenkill councilman based on his unfitness to serve on the Poestenkill town board.

BURZESI BARKS UP WRONG TREE IN POESTENKILL WITH BLATANT ATTACK ON PROTECTED POLITICAL SPEECH!
As to the saying "barking up the wrong tree" in reference to Poestenkill councilman Frank Burzesi, it means "pursuing a mistaken or misguided line of thought or course of action," which thought takes us to the question of should we residents of Poestenkill who know better be at all surprised that Hammond crony and political stable-mate Frank Burzesis is displaying what could well be called "fascist tendencies" with regard to suppressing Constitutionally-protected political speech in Poestenkill as was recently demonstrated by the Poestenkill councilman during the October 10, 2024 meeting of the Poestenkill Town Board https://www.youtube.com/watch?v=6MvxQjuiepY at 42:26, where he very publicly attacked Poestenkill resident and exemplary citizen Patrick Wing for publishing an informative citizen newsletter titled Poestenkill Spotlight Fall 2024 without seeking prior approval to do so from the Town of Poestenkill?
And that answer, for those of us who know better, is clearly, of course not.
Like his political crony Keith Hammond, councilman Burzesi is for strict control of both political speech and political thought in Poestenkill, and as he demonstrated on October 10, 2024 with his attack on Patrick Wing, the councilman has no patience with those like Mr. Wing in Poestenkill who do not obey the dictates of the councilman by seeking his approval beforehand before publishing what is protected political speech in Poestenkill.
And while councilman Burzesi allegedly swore an oath pursuant to Article XIII, Section 1 of the New York State Constitution before taking office to support the constitution of the United States of America and the constitution of the State of New York, the fact of the matter as he proved on October 10, 2024 with his jeremiad against Poestenkill resident Patrick Wing for daring to engage in Constitutionally-protected political speech without Burzesi's prior approval, that oath to support the constitution of the United States of America and the constitution of the State of New York, is that that oath, if even taken, was nothing more than empty words by the councilman that he has no intention whatsoever of actually living up to.
As to protected political speech in Poestenkill, which is and remains a part of the United States of America where the Constitution of the United States of America remains law of the land, even if disregarded and denied by councilman Burzesi, the First Amendment to that Constitution states as follows:
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
So, if Congress can make no law abridging the freedom of speech, where would Poestenkill councilman Franki Burzesi get the right to do?
And that answer is he has no such right under law, which of course, is no bar or impediment to Burzesi acting in an unconstitutional and lawless manner as he clearly did on October 10, 2024 with his blatant attack on Patrick Wing while the councilman sat at the high table as a member of the Poestenkill town board, which had him acting under color of law, as if being a town councilman in Poestenkill gives him some kind of right or power to curtail or chill or punish political speech in Poestenkill.
So why is this important?
It is because the First Amendment gives EVERYONE residing in the United States, which would have to include all the resident of Poestenkill, the right to hear all sides of every issue and to make their own judgments about those issues without government interference or limitations.
The First Amendment allows individuals like Patrick Wing of Poestenkill to speak, publish, read and view what they wish, worship (or not worship) as they wish, associate with whomever they choose, and gather together to ask the government to make changes in the law or to correct the wrongs in society.
The right to speak and the right to publish under the First Amendment has been interpreted widely to protect individuals like Patrick Wing and society in Poestenkill from government attempts to suppress ideas and information, and to forbid government censorship of books, magazines, and newspapers as well as materials on the internet.
The Supreme Court and other courts have held conclusively that there is a First Amendment right to receive information as a corollary to the right to speak.
Justice William Brennan elaborated on this point in 1965:
“The protection of the Bill of Rights goes beyond the specific guarantees to protect from Congressional abridgment those equally fundamental personal rights necessary to make the express guarantees fully meaningful."
"I think the right to receive publications is such a fundamental right."
"The dissemination of ideas can accomplish nothing if otherwise willing addressees are not free to receive and consider them."
"It would be a barren marketplace of ideas that had only sellers and no buyers.” Lamont v. Postmaster General, 381 U.S. 301 (1965).
The Supreme Court reaffirmed that the right to receive information is a fundamental right protected under the U.S. Constitution when it considered whether a local school board violated the Constitution by removing books from a school library.
In that decision, the Supreme Court held that “the right to receive ideas is a necessary predicate to the recipient’s meaningful exercise of his own rights of speech, press, and political freedom.” Board of Education v. Pico, 457 U.S. 853 (1982)
And quite clearly, with his October 10. 2024 attack on Patrick Wing for daring to publish the Poestenkill Spotlight without express permission beforehand from the Poestenkill town board to do so, Poestenkill councilman Frank Burzesi wishes to strip the citizens of Poestenkill of the right to receive ideas as a necessary predicate to the recipient’s meaningful exercise of his own rights of speech, press, and political freedom.”
A serious matter, indeed, people!
So why then should we as free people tolerate this abuse of our rights by Hammond crony Frank Burzesi?

FOOLISH BURZESI ATTACK ON PROTECTED SPEECH BACKS POESTENKILL INTO A CORNER!
With his deranged attack on the Constitutionally-protected right of Poestenkill resident Patrick Wing to use the logo of the Town of Poestenkill as a visual symbol on a newsletter titled Poestenkill Spotlight, not only has Poestenkill councilman Frank Burzesi, a New York state licensed professional engineer with a duty 24/7/365 to safeguard life, health and property by complying with substantial provisions of Federal, State or local laws, rules or regulations governing the practice of the profession, which would start with Constitutional rights, made himself out to be an ignorant, thuggish scofflaw, a character trait that endeared him to his political crony Keith Hammond, but more importantly to the residents of Poestenkill, he has managed to blunder Poestenkill into another slam-dunk losing federal civil rights lawsuit on the heels of Hitchcock v. Town of Poestenkill, New York et al, which civil rights lawsuit was as a result of sheer stupidity on the part of Burzesi crony Keith Hammond and his inept code enforcer officer Tracy Church, because when it comes to Constitutionally-protected speech, the federal courts have a low bar for a plaintiff to prevail, and by threatening Patrick Wing, Frank Burzesi crossed that line, and has no way back, to wit:
BURZESI: You want to put a letter out that says it is from you, that's fine, try to keep the Town logo off - maybe it's not legal, maybe it is legal - I just don't care.
Now, at the time Burzesi uttered those words, he was in fact seated at the high table as a Poestenkill town councilperson, so he was speaking as a public official of Poestenkill, not a private citizen, a fact that makes all the difference in the world in a federal civil rights lawsuit against Poestenkill, especially given Burzesi's admission that he really didn't have a clue as to what he was talking about when he said on the official record as a Poestenkill councilman that he didn't know if the use of the Poestenkill logo by a Town resident was legal or not and he just didn't care.
Talk about a real stupid statement on the record and putting one's foot in one's mouth while hoisting oneself by his own petard, there is a vivid example of it right there, courtesy of Poestenkill councilman Frank Burzesi, NYSPE # #070866.
In point of fact, and this is unarguable, Patrick Wing was clearly using the Town logo in an expressive manner, and that expression is political expression, entitled to the highest degree of constitutional protection. See Thornhill v. Alabama, 310 U.S. 88, 101, 60 S.Ct. 736, 84 L.Ed. 1093 (1940) (“The freedom of speech and of the press guaranteed by the Constitution embraces at the least the liberty to discuss publicly and truthfully all matters of public concern....”).
So much for Poestenkill councilman Frank Burzesi not knowing whether or not the use of the Town logo for political expression was legal or not, and I would love to see councilman Burzesi on the witness stand before a jury in federal court trying to explain that away to the jury!
Burzesi argues that a viewer could be misled by Mr. Wing's use of the Poestenkill logo, but to date, he has not submitted any evidence that other than him, and perhaps the town supervisor, anyone was, or was likely to be, deceived by Mr. Wing's use of the Poestenkill logo as a political symbol next to the word "Spotlight" on the front cover of the document under attack by Mr. Burzesi, and in fact, given the return address of Holser Road, it would be impossible for a normal person in Poestenkill to be deceived into thinking the document was from the Town of Poestenkill, because if it was from the Town of Poestenkill, the return address would have made that clear.
As the United States Supreme Court clearly stated in Elrod v. Burns, 427 U.S. 347, 373, 96 S.Ct. 2673, 49 L.Ed.2d 547 (1976),“The loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury,” and the chilling of Mr. Wing's expressive activity because of the overt or implied threats of retaliation by Poestenkill councilman Burzesi on October 10, 2024 causing Mr. Wing to forgo constitutionally protected activity out of a legitimate fear of harm by Poestenkill, a Town with a well-documented record of political retaliation, thus constitutes irreparable injury in the eyes of the law in federal court.
For the record, the First Amendment prevents public institutions from compromising individuals' First Amendment freedoms by establishing a framework that defines critical rights and responsibilities regarding free expression and the freedom of belief as Poestenkill is attempting to do here by threatening Mr. Wing with harm and political retaliation.
Rather than engaging in censorship and repression to advance one's values and beliefs, Supreme Court Justice Louis Brandeis counsels persons living in the United States to resolve their differences in values and belief by resort to "more speech, not enforced silence."
With respect to the applicability of the First Amendment in Poestenkill, by virtue of the Fourteenth Amendment, the First Amendment's constitutional right of free speech and intellectual freedom also applies to state and local governments.
Government agencies and government officials are forbidden from regulating or restricting speech or other expression based on its content or viewpoint.
Criticism of the government and political dissatisfaction are always protected by the First Amendment, and the First Amendment prevents government restrictions on speech.
As to censorship in Poestenkill, it is the suppression of ideas and information that some government officials like Poestenkill's Franki Burzesi find objectionable, and would-be censors lie Poestenkill's Franki Burzesi try to use the power of the "state" to impose their view of what is truthful and appropriate, or offensive and objectionable, on everyone else.
Censors like Poestenkill's Frank Burzesi pressure members of the public like Patrick Wing to suppress and remove information they judge inappropriate or dangerous from public access, so that no one else has the chance to read or view the material and make up their own minds about it.
The censor, in this case, Poestenkill's Frank Burzesi, wants to prejudge materials for everyone: “Don’t let anyone read this newsletter because I object to it!”
Do we want or need censorship in Poestenkill because Frank Burzesi wants censorship?

Burzesi argues that a viewer could be misled by Mr. Wing's use of the Poestenkill logo, but to date, he has not submitted any evidence that other than him, and perhaps the town supervisor, anyone was, or was likely to be, deceived by Mr. Wing's use of the Poestenkill logo as a political symbol next to the word "Spotlight" on the front cover of the document under attack by Mr. Burzesi, and in fact, given the return address of Holser Road, it would be impossible for a normal person in Poestenkill to be deceived into thinking the document was from the Town of Poestenkill, because if it was from the Town of Poestenkill, the return address would have made that clear.
As the United States Supreme Court clearly stated in Elrod v. Burns, 427 U.S. 347, 373, 96 S.Ct. 2673, 49 L.Ed.2d 547 (1976),“The loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury,” and the chilling of Mr. Wing's expressive activity because of the overt or implied threats of retaliation by Poestenkill councilman Burzesi on October 10, 2024 causing Mr. Wing to forgo constitutionally protected activity out of a legitimate fear of harm by Poestenkill, a Town with a well-documented record of political retaliation, thus constitutes irreparable injury in the eyes of the law in federal court.
For the record, the First Amendment prevents public institutions from compromising individuals' First Amendment freedoms by establishing a framework that defines critical rights and responsibilities regarding free expression and the freedom of belief as Poestenkill is attempting to do here by threatening Mr. Wing with harm and political retaliation.
Rather than engaging in censorship and repression to advance one's values and beliefs, Supreme Court Justice Louis Brandeis counsels persons living in the United States to resolve their differences in values and belief by resort to "more speech, not enforced silence."
With respect to the applicability of the First Amendment in Poestenkill, by virtue of the Fourteenth Amendment, the First Amendment's constitutional right of free speech and intellectual freedom also applies to state and local governments.
Government agencies and government officials are forbidden from regulating or restricting speech or other expression based on its content or viewpoint.
Criticism of the government and political dissatisfaction are always protected by the First Amendment, and the First Amendment prevents government restrictions on speech.
As to censorship in Poestenkill, it is the suppression of ideas and information that some government officials like Poestenkill's Franki Burzesi find objectionable, and would-be censors lie Poestenkill's Franki Burzesi try to use the power of the "state" to impose their view of what is truthful and appropriate, or offensive and objectionable, on everyone else.
Censors like Poestenkill's Frank Burzesi pressure members of the public like Patrick Wing to suppress and remove information they judge inappropriate or dangerous from public access, so that no one else has the chance to read or view the material and make up their own minds about it.

FOR WHAT DID FRANK BURZESI NEED A LAWYER?
No one in Poestenkill who regularly watches the antics of the Poestenkill Town Board as it goes about "governing" Poestenkill like the Keystone Cops would ever be foolish enough to try and claim that what goes on in Poestenkill Town Hall when the Town Board is in session makes a lick of sense to a sane and rational person, and case in point was an exchange that took place in Poestenkill Town Hall on October 10, 2024 between Poestenkill resident Lee King and Democrat supervisor Tom Russell concerning the Poestenkill town park, which exchange began with Mr. King asking a very simple question of councilman Frank Burzesi at 56:24 of the official record, to wit:
LEE KING: There is a need for an official resolution to be brought before the Town Board for a vote, yes or no, to adopt the resolution or to not.
Now, I'm going to go back to you, councilman Burzesi, do you favor that there would be a resolution drafted in legal form brought before the Town Board for a yes or no vote?

Now, before going further, here it must be said that in addition to being a Poestenkill councilperson, Frank Burzesi is also licensed in the state of New York as a professional engineer, and to obtain that license, councilman Burzesi was required to have a minimum of four years of college education, which education would have supplied councilman Burzesi with a working vocabulary more that sufficient to provide him with words adequate to the purpose of responding to that simple question, which required nothing more than a simple yes or no answer, something Mr. Burzesi's engineering education would have supplied him with the necessary intellectual horsepower to be able to do.
But before councilman Burzesi could respond to this simple question, Poestenkill town supervisor Russell jumped in as follows to quash the line of inquiry put forth to councilman Burzesi by Mr. King, which is where the proceedings turned distinctly bizarre and weird, to wit:
RUSSELL: I respect - we do not have legal representation tonight, Lee, I understand your point but I respectfully ask that you not continue with that particular questioning here on this matter.

Now, what makes this truly bizarre in Poestenkill fashion is that this same Frank Burzesi had only just finished publicly excoriating Poestenkill town resident Patrick Wing in that same meeting, without legal representation being present, calling down anathema on Mr. Wing in a jeremiad Frank Burzesi had no trouble finding words for on his own, because Mr. Wing had dared to publish an informative town newsletter titled "Poestenkill Spotlight" without prior permission and approval from the Poestenkill town board, and all the time that excoriation went on, supervisor Russell sat there mute and let it happen, despite there being no legal representation present.
So why then, after allowing Frank Burzesi to publicly attack Patrick Wing for exercising his Constitutional right to engage in protected political speech in Poestenkill did supervisor Russell feel it necessary to step in and shield Frank Burzesi, as if Tom Russell were pleading the Fifth Amendment for him, lest Mr. Burzesi, who had already incriminated himself with his attack on Patrick Wing, somehow incriminate himself answering Mr. King's simple question?

A CORRECTION, AND PRIOR RESTRAINT
With respect to the correction, according to reliable witnesses who were actually present in Poestenkill Town Hall on October 10, 2024, the quote in the October 14th 2024 Edition of the Gazette titled "FREEDOM OF SPEECH CAUSES HUGE STINK IN POESTENKILL TOWN HALL!" that was attributed to Poestenkill supervisor Russell should actually be attributed to Poestenkill councilman David Hass, to wit:
HASS: I think you are both right, actually.
He does have a right to free speech absolutely but he should not make it look like it came from the Town and that's really the issue here.

And actually, councilman Hass himself is dead wrong, along with councilman Burzesi, because that document in question, the "Poestenkill Spotlight" does not look like it came from the Town of Poestenkill, at all, and somebody would have to be short on wits and sense to think it did.
IF the document had actually come from the Town, the return address in the upper left hand corner of the address page would have clearly stated as follows:

I know that to be so because I just copied it off of the envelope of a letter that I got in the mail that was actually from the Town of Poestenkill, and it is of interest that each member of the Town Board, plus the supervisor, are apparently ignorant of the fact that when the Town of Poestenkill does send out something to the Town residents, it uses its own return address, as above.
So that when anybody, including each Town councilperson and the supervisor, looked at the address page of the "Poestenkill Spotlight," of which we need many more issues in this town, and saw the return address of 6 Holser Road, Averill Park, NY 12018, that alone would have served as a give=away to inform the reader that it was not from the Town of Poestenkill, at all.
And that is dangerous ignorance, indeed, on the p0art of the Poestenkill town board when we consider that these are the very same people we are trusting our futures and the future of this town to, that any of those people sitting there at the high table could be so very ignorant of that fact, so that they would not have looked such fools as they did, with their claims that people in Poestenkill could have possibly thought the "Poestenkill Spotlight," which was intended to shine a spotlight on political doings in the town, was produced by the Town of Poestenkill, itself.
Which raises the serious question of how safe our futures are in the hands of these same people who apparently don't know night from day!
As to the term "prior restraint," which was a subject taught to me in Poestenkill Elementary School back in the 1950's, it is a legal term for the "government," in this case, the Poestenkill town board, censoring our speech before we say something or censoring news before it is published, and “prior restraint” sits near the top of things that violate the First Amendment.
“Prior restraint” is a form of censorship that prevents thoughts and ideas from ever entering public conversation, which is why Poestenkill engages in the practice, as was the case during the Water District No. 2 flim-flam, and before that,k the PFAS white-wash.
Free expression is an important part of not only our U.S. democracy, but "democracy," such as it is, in Poestenkill, as well, and prior restraint limits this right to free speech and press and censors speech protected by the Constitution.

A CORRECTION, AND PRIOR RESTRAINT
With respect to the correction, according to reliable witnesses who were actually present in Poestenkill Town Hall on October 10, 2024, the quote in the October 14th 2024 Edition of the Gazette titled "FREEDOM OF SPEECH CAUSES HUGE STINK IN POESTENKILL TOWN HALL!" that was attributed to Poestenkill supervisor Russell should actually be attributed to Poestenkill councilman David Hass, to wit:
HASS: I think you are both right, actually.
He does have a right to free speech absolutely but he should not make it look like it came from the Town and that's really the issue here.

And actually, councilman Hass himself is dead wrong, along with councilman Burzesi, because that document in question, the "Poestenkill Spotlight" does not look like it came from the Town of Poestenkill, at all, and somebody would have to be short on wits and sense to think it did.
IF the document had actually come from the Town, the return address in the upper left hand corner of the address page would have clearly stated as follows:

I know that to be so because I just copied it off of the envelope of a letter that I got in the mail that was actually from the Town of Poestenkill, and it is of interest that each member of the Town Board, plus the supervisor, are apparently ignorant of the fact that when the Town of Poestenkill does send out something to the Town residents, it uses its own return address, as above.
So that when anybody, including each Town councilperson and the supervisor, looked at the address page of the "Poestenkill Spotlight," of which we need many more issues in this town, and saw the return address of 6 Holser Road, Averill Park, NY 12018, that alone would have served as a give=away to inform the reader that it was not from the Town of Poestenkill, at all.
And that is dangerous ignorance, indeed, on the p0art of the Poestenkill town board when we consider that these are the very same people we are trusting our futures and the future of this town to, that any of those people sitting there at the high table could be so very ignorant of that fact, so that they would not have looked such fools as they did, with their claims that people in Poestenkill could have possibly thought the "Poestenkill Spotlight," which was intended to shine a spotlight on political doings in the town, was produced by the Town of Poestenkill, itself.
Which raises the serious question of how safe our futures are in the hands of these same people who apparently don't know night from day!
As to the term "prior restraint," which was a subject taught to me in Poestenkill Elementary School back in the 1950's, it is a legal term for the "government," in this case, the Poestenkill town board, censoring our speech before we say something or censoring news before it is published, and “prior restraint” sits near the top of things that violate the First Amendment.
“Prior restraint” is a form of censorship that prevents thoughts and ideas from ever entering public conversation, which is why Poestenkill engages in the practice, as was the case during the Water District No. 2 flim-flam, and before that,k the PFAS white-wash.
Free expression is an important part of not only our U.S. democracy, but "democracy," such as it is, in Poestenkill, as well, and prior restraint limits this right to free speech and press and censors speech protected by the Constitution.
With respect to retaliation and punishment in Poestenkill for speaking out on matters of public concern in Poestenkill without prior approval from supervisor Russell and the town board, members of a community watch network in the Liberty Lane area of Poestenkill report that for the last several days, and including this morning, 1 November 2024, this since the Poestenkill Gazette began reporting on the very uncivil and incredible attack on the First Amendment rights of Poestenkill town resident Patrick Wing by Poestenkill councilman Frank Burzesi, NYSPE # #070866, when they drive on the public road in Poestenkill known as Liberty Lane in the early morning hours when it is still dark, as they come to that stretch of Liberty Lane long since known more properly as HATE ALLEY in Poestenkill, which is that stretch of Liberty Lane from just west of the driveway of Poestenkill engineer Paul Plante, also the editor of the Poestenkill Gazette, to Weatherwax Road. that as they pass a yellow house on the North side of Liberty Lane just west of where Plante resides, that they are hit in the eyes by a burst of light from what is known as a "light trap" in Poestenkill, where to harass and intimidate someone Poestenkill wishes retaliated against for engaging in political speech without proper prior approval, the same offence committed by Patrick Wing when he published the "Poestenkill Spotlight" without express permission from Poestenkill to do so beforehand, spotlights with sensors to detect a passing car are mounted so that the light beam comes out on such a path as to strike a passing motorist in the eyes, which menacing behavior is very effective as a tool of intimidation and retaliation in Poestenkill.
While Poestenkill supervisor Russell prattles on during Town Board meetings about how he expects and demands civility from the people of Poestenkill, at the same time, he had absolutely no problems or issues whatsoever with his political crony Frank Burzesi publicly treating Patrick Wing in a very uncivil manner on October 10, 2024 during a public meeting in Poestenkill broadcast to the world on Youtube by calling him out by name as a "wrong doer" in Poestenkill for exercising in a lawful manner his Constitutional right to engage in political speech in Poestenkill, nor does the supervisor have any issues with the "light traps" on Liberty Lane which are intended to let Plante know that he is not welcome in Poestenkill and should do the "right thing," and leave.
While every resident of Poestenkill, including Plante, should have every right to travel on the public road known as Liberty Lane in the town of Poestenkill unmolested, which would start with not getting hit in the eyes by a light beam from a spotlight aimed at the road, that clearly is not so on the HATE ALLEY section of Liberty Lane in Poestenkill, where harassment, intimidation and uncivility reign.
This on-going assault on the senses of drivers on Liberty Lane, including Plante, is in obvious retaliation for his engaging in Constitutionally-protected speech as a town resident by publishing an article in the Poestenkill Gazette concerning the Town of Poestenkill's blatant attack during the Poestenkill Town Board meeting on October 10, 2024 on another town resident, which blatant attack on Patrick Wing October 10, 2024 by Poestenkill councilman Burzesi while supervisor Russell sat there and let it happen, was an attack the exercise of all of our First Amendment right to engage in protected political speech in Poestenkill.

Now, to understand those words, and to comprehend the meaning of those words, does not require a JD degree from Harvard, or a Ph.D in PolySci from Yale, or even a high school education, because I learned those words and the meaning of those words as a kindergartner in the then-new Poestenkill Elementary School in the early-1950's, so what excuse can Poestenkill councilman Frank Burzesi, himself licensed as a professional engineer in New York state to safeguard life, health and property, offer us to explain why he is ignorant of those words and their meaning in his efforts to suppress, censor and control the speech of Poestenkill resident Patrick Wing?
What particular deficit in his education has him thinking he can come "carpet-bag" his way into Poestenkill and then trample on our Constitutional rights like he is a tin-pot potentate in some third-world banana republic?
This publication believes that he owes we, the people of Poestenkill, an answer to that question.
Going back to the executive order, it continues, as follows:
In a country that has long cherished the freedom of expression, we cannot allow a limited number of online platforms to hand pick the speech that Americans may access and convey on the internet.
This practice is fundamentally un-American and anti-democratic.
When large, powerful social media companies censor opinions with which they disagree, they exercise a dangerous power.

And when town boards in America like the Poestenkill town board can hand pick the speech that Americans may access and convey either on the internet or by mail, as was the case with the "Poestenkill Spotlight," that practice as well is fundamentally un-American and anti-democratic, and when town boards in America like the Poestenkill town board can censor opinions with which they disagree, as was the case with the Water District No. 2 flim-flam, and the CCCDW PFAS white-wash, they too exercise a dangerous power.

The growth of online platforms in recent years raises important questions about applying the ideals of the First Amendment to modern communications technology.
Today, many Americans follow the news, stay in touch with friends and family, and share their views on current events through social media and other online platforms.
As a result, these platforms function in many ways as a 21st century equivalent of the public square.

Ah, yes, the "public square," which we in Poestenkill do not have, because the Postenkill town board considers it "threatening," hence, the publication of the "Poestenkill Spotlight."

Going back to the executive order, it states that free and open debate is essential to sustaining our democracy, while online platforms are engaging in selective censorship that is harming our national discourse, and in our case, Poestenkill councilman Frank Burzesi engaging in selective censorship is harming our discourse here in Poestenkill.
From whence comes his power to do so?
And when can we expect his answer to that important question?

Members of a neighborhood watch driving on Weatherwax Road just off Rt. 66 this morning at around 5:10 AM made note of the fact that what are being called Poestenkill's Nazi concentration camp spotlights, high-intensity spotlights such as are used to illuminate the yard at the Rensselaer County jail that are mounted on the north side of the brick house owned by Patricia and David Gettings on the west end of Liberty Lane, known locally as "Hate Alley," were once again in operation, lighting up a patch of woods owned by Poestenkill engineer Paul R. Plante, PE, an object of pure hatred in Poestenkill for daring to challenge endemic corruption in Poestenkill, something that simply is not done if one knows what is good for oneself, so that it appears to passersby and Plante as if Poestenkill's version of the Ku Klux Klan were holding a mass cross burning in the woods with Poestenkill's encouragement and permission, all to strike fear into the heart of professional engineer Paul R. Plante, who has resided on Liberty Lane for over fifty years, this in order to cow Plante into submission, with the hope of making life for Plante, listed in a May 1990 Report to the then-Poestenkill town board by then-Poestenkill dog control officer Christine R. Lincoln as a "well-known agitator," which is an indication of just how long Poestenkill's "Hate Campaign" against Plante has been on-going, so ugly that Plante will be forced to have to flee his home in Poestenkill for his peace of mind and safety.
Whatever may be the case in other towns in New York, or America, for that matter, given that in theory, we are all supposed to be American citizens with the same supposed rights, regardless of what town we live in, in Poestenkill, where we are ruled, not governed, political dissent is not tolerated, as Poestenkill resident Patrick Wing, known as an exemplary town citizen, found at the October 10, 2024 Poestenkill town board meeting when he was personally called out as another object of hatred in this town by Hammond crony and Poestenkill councilman Frank Burzesi, NYSPE # #070866 for exercising his Constitutional right to engage in protected political speech, something not tolerated in Poestenkill, and when political dissent rises to the level of the filing of successful Article 78's by a dissenting town inhabitant such as Plante against the Poestenkill town board, or the Poestenkill planning board, challenging their unlawful and lawless actions, i.e. crimes, in a court of law, and thereby exposing political corruption in Poestenkill for all the world to see, as has been the case in Matter of Paul R. "LET'S ALL PILLORY PATRICK WING!"
Yes, people, "pillory" in the sense of "tie him to the whipping post," or more appropriately, confine him in a pillory post to expose him justly to public contempt, ridicule, or scorn by every resident of Poestenkill called out in assembly for the occasion, said pillory post to be erected in Poestenkill's new park paid for in full with ARPA funds, and said park to be henceforth known as "Poestenkill Pillory Post Park," as a stark warning to present and future generations in Poestenkill of the fate that awaits those who themselves might be tempted to engage in the sheer folly of the wrong thinking of Poestenkill resident Patrick Wing, who was audacious (showing an impudent lack of respect) enough to think that he could, with impunity (exemption from punishment or freedom from the injurious consequences of an action) get away in Poestenkill with engaging in Constitutionally protected political speech without first securing permission from Poestenkill to engage in Constitutionally protected political speech, which is an abuse of Mr. Wing's First Amendment right to engage in protected political speech, and further, without submitting his proposed political speech to Poestenkill's Grand Inquisitor and Chief Censor Frank Burzesi, NYSPE # #070866 for clearance and approval before actually speaking, in order to protect the peace and tranquility and public morals of Poestenkill, as well as our sacred democracy in Poestenkill and the Soul of America and our national security, to boot.
As Grand Inquisitor Burzesi made crystal clear during the October 10, 2024 meeting of the Poestenkill Town Board https://www.youtube.com/watch?v=6MvxQjuiepY at 42:26, the evidence against Mr. Wing is overpowering, overwhelming, incontrovertible, damning, indisputable, incontestable, undeniable, irrefutable, unassailable, beyond dispute, unquestionable, indubitable, unarguable, and undebatable, and thus, Mr. Wing is soundly deserving of every single scrap of pure opprobrium we can muster up for going against the public order in Poestenkill by speaking without prior permission to speak, and without prior clearance of what he was going to speak about, right out in plain sight, as if trying to provoke others in Poestenkill to engage in similar acts of civil disobedience in Poestenkill, to the detriment of civilized society in Poestenkill as we know it today and wish it to be preserved.
And indeed, where Grand Inquisitor Burzesi has made clear that Patrick Wing did not appear to be acting on his own, but was in fact involved in some sort of cabal or junto with other similarly minded malefactors in Poestenkill brazen enough to think they can all engage in protected political speech without first seeking permission from Grand Inquisitor Burzesi, we should demand that Poestenkill's Committee for Detecting and Defeating Conspiracies in the Town of Poestenkill should be activated post haste to root out these other malefactors so they too can be put on display with Mr. Wing on what will be known to history as "Persecute Patrick Wing Day" at Poestenkill Pillory Post Park, and let us thereby nip this civil unrest in Poestenkill in the bud!

"LET'S ALL PILLORY PATRICK WING!"
Yes, people, "pillory" in the sense of "tie him to the whipping post," or more appropriately, confine him in a pillory post to expose him justly to public contempt, ridicule, or scorn by every resident of Poestenkill called out in assembly for the occasion, said pillory post to be erected in Poestenkill's new park paid for in full with ARPA funds, and said park to be henceforth known as "Poestenkill Pillory Post Park," as a stark warning to present and future generations in Poestenkill of the fate that awaits those who themselves might be tempted to engage in the sheer folly of the wrong thinking of Poestenkill resident Patrick Wing, who was audacious (showing an impudent lack of respect) enough to think that he could, with impunity (exemption from punishment or freedom from the injurious consequences of an action) get away in Poestenkill with engaging in Constitutionally protected political speech without first securing permission from Poestenkill to engage in Constitutionally protected political speech, which is an abuse of Mr. Wing's First Amendment right to engage in protected political speech, and further, without submitting his proposed political speech to Poestenkill's Grand Inquisitor and Chief Censor Frank Burzesi, NYSPE # #070866 for clearance and approval before actually speaking, in order to protect the peace and tranquility and public morals of Poestenkill, as well as our sacred democracy in Poestenkill and the Soul of America and our national security, to boot.
As Grand Inquisitor Burzesi made crystal clear during the October 10, 2024 meeting of the Poestenkill Town Board https://www.youtube.com/watch?v=6MvxQjuiepY at 42:26, the evidence against Mr. Wing is overpowering, overwhelming, incontrovertible, damning, indisputable, incontestable, undeniable, irrefutable, unassailable, beyond dispute, unquestionable, indubitable, unarguable, and undebatable, and thus, Mr. Wing is soundly deserving of every single scrap of pure opprobrium we can muster up for going against the public order in Poestenkill by speaking without prior permission to speak, and without prior clearance of what he was going to speak about, right out in plain sight, as if trying to provoke others in Poestenkill to engage in similar acts of civil disobedience in Poestenkill, to the detriment of civilized society in Poestenkill as we know it today and wish it to be preserved.
And indeed, where Grand Inquisitor Burzesi has made clear that Patrick Wing did not appear to be acting on his own, but was in fact involved in some sort of cabal or junto with other similarly minded malefactors in Poestenkill brazen enough to think they can all engage in protected political speech without first seeking permission from Grand Inquisitor Burzesi, we should demand that Poestenkill's Committee for Detecting and Defeating Conspiracies in the Town of Poestenkill should be activated post haste to root out these other malefactors so they too can be put on display with Mr. Wing on what will be known to history as "Persecute Patrick Wing Day" at Poestenkill Pillory Post Park, and let us thereby nip this civil unrest in Poestenkill in the bud!

And how is it that I not only know that, but can say it in public with a certain authority?
And that answer is quite simple - we all in Poestenkill who pay close and intense attention to every single word, no matter how nuanced, uttered by our masters and betters, the finest and sharpest minds in Poestenkill, Russell, Wohlleber, Hass, Butler, and Burzesi, who are seated where they should properly be, above us all at the high table in Poestenkill town hall, when the Poestenkill town board is in session, heard Poestenkill councilman Frank Burzesi, NYSPE # #070866, who is also Poestenkill's Grand Inquisitor and Chief Censor, as well as High Commissioner of Poestenkill's Committee for Detecting and Defeating Conspiracies in the Town of Poestenkill, say so on the official record the Town of Poestenkill Town Board Meeting for October 10, 2024, at 43:55 https://www.youtube.com/watch?v=6MvxQjuiepY as follows:

And there, people, is the true and heinous nature of Patrick Wing's multitudinous "crimes" against good order and social justice and equity in Poestenkill revealed for all to see - by daring to publish the Poestenkill Spotlight in Poestenkill without express prior written approval given after Poestenkill Chief Censor Burzesi had a full and complete opportunity to properly scrutinize the document, which he clearly was deprived of intentionally by Mr. Wing in an act of open rebellion more detrimentally serious to harmony and good feelings here in Poestenkill than was Shay's Rebellion in western Massachusetts back when, Patrick Wing totally and perhaps fatally upended the "equilibrium" that the town itself had been working very hard to keep things on since January of 2024, when Democrat Russell took command of Poestenkill as our new Gauleiter, and clearly, Poestenkill resident Patrick Wing has no possible defense to the very serious charge that did result in him being attainted and outlawed and banished from Poestenkill by order of the Poestenkill Committee for Detecting and Defeating Conspiracies in the Town of Poestenkill, as was only proper, given the serious circumstances of the matter, where above all else, "equilibrium" in Poestenkill is paramount, if we are to have a town, while at the same time, all doing our part in these seriously divided times in America to win the fight for the Soul of America at this point of inflection where we have been hovering in this troubled nation these last four or more years.

The key words there are "civil" (cultured and polite, as in someone who is civilized) and "organized" (arranged in a systematic way), and for things in Poestenkill to be both civil and organized, it is beyond cavil (not to be doubted or argued about) that we cannot have a multiplicity of thought in Poestenkill - everyone, for there to be civic harmony in Poestenkill, EVERYONE, and this would include Patrick Wing, must of necessity all being thinking the same things at the same time, as those things to think about or not give any thought to are dictated to us by our betters at the high table.
Divergence of thought, such as Patrick Wing was trying to promote with his Poestenkill Spotlight, is fatal to the maintenance of equilibrium in Poestenkill, and so must be mercilessly stamped out, wherever it may rear its ugly head here in Poestenkill.
